Terms of service

These terms are the agreement between you and GoldenBerry Software OÜ ("GoldenBerry", "we") for using MakeFlow, its companion app and this website. By using the service, you agree to these terms. If you act for a studio or business, you must have authority to do so.

Your account and access

You must be at least 13 and meet the age and capacity requirements where you live. Keep your email account, sign-in codes, sessions and device credentials secure. Give accurate account information and tell us about suspected unauthorized access. You are responsible for people and integrations you authorize to act for your studio.

Subject to these terms and your plan, we grant you a non-exclusive right to access MakeFlow and use its companion app. This does not transfer ownership of the service, name, logo or design. Your workshop content remains yours.

Your workshop information

You give us permission to host, process, display and transmit your content as needed to provide the features you use. You must have the right to upload it and process any personal information it contains. You remain responsible for customer records, recipient permissions, financial decisions and legal obligations. Keep copies of records your business needs.

Orders, expenses, invoices and production reports are management tools. Their accuracy depends on the information entered and how you use them. MakeFlow does not provide accounting, tax or legal advice.

AI, voice and automation

AI can make mistakes, interpret a request incorrectly or return incomplete information. Review generated content and changes, especially quantities, recipients and financial details. Chippy and configured automations can read and change records within your permissions. Saved actions can remain effective after you stop a response or lose a connection; check the resulting record before retrying.

AI features have plan-specific allowances shown in the app. Admitted requests can count even when processing fails or is cancelled. Monthly allowances renew on the documented UTC schedule. Usage measurements support allowances, cost analysis and reconciliation. We will disclose and obtain agreement to any new paid metering arrangement before charging under it.

Plans and payment

Early-access signup does not buy a paid subscription. New accounts receive a 14-day free trial from account creation, subject to trial allowances. There is no ongoing free plan. After the trial, a paid plan is required to continue creating or changing studio work; existing records remain readable and supported exports remain available. The trial does not automatically charge you. Maker is €39/month or €390/year; Team is €69/month or €690/year. Paid plans are available only where purchasing is enabled. Prices, currency, billing interval, taxes and any immediate change charges are shown before you confirm a purchase or plan change.

A recurring plan renews on the terms shown at checkout until cancelled. Use the available billing controls or contact us to arrange cancellation. Unless the purchase terms say otherwise, cancellation stops future renewal and paid access continues for the period already paid. A downgrade or cancellation does not by itself delete your workspace.

Stripe handles enabled payment processing. Contact us about refunds; mandatory withdrawal, refund and consumer rights remain unaffected. We will communicate material price changes before they apply to a future billing period.

Acceptable use

• Use MakeFlow lawfully and respect privacy and intellectual property.
• Do not send spam, upload unlawful content or use integrations without the necessary permissions.
• Do not bypass access controls, impersonate another account, interfere with the service or access another studio's data.
• Do not resell the service, remove ownership notices or extract protected software except where permitted by law or agreed with us.

Privacy and measurement

The privacy notice explains account and workshop processing, AI providers, diagnostics, sampled session recordings and the separate AI ledger. MakeFlow includes product measurement in configured environments. Agreement to these terms does not replace separate consent where tracking law requires it.

Availability and changes

We may update features, integrations and supported platforms. Early-access features can be incomplete or change, and third-party services can interrupt availability. We do not promise uninterrupted operation or support for every device. We will give appropriate notice of material service changes affecting a paid subscription, subject to urgent security or legal needs.

Suspension and ending use

You can stop using MakeFlow and request account closure. Stopping use alone does not cancel a recurring subscription; arrange cancellation through billing or contact us. We may restrict or suspend access for material breaches, security risks or legal requirements. Where appropriate, we will explain the reason and give an opportunity to resolve it.

Closure and deletion requests follow the privacy notice, including records that must be retained. Terms that need to continue, including payment obligations already incurred, ownership and liability provisions, survive termination.

Warranties and liability

To the extent permitted by law, MakeFlow is provided "as is" and "as available". We do not guarantee it will be error-free or suitable for every purpose. Nothing here excludes warranties, remedies or responsibilities that cannot lawfully be excluded.

To the extent permitted by law, GoldenBerry is not liable for indirect or consequential losses, including lost profits or revenue. Where a cap is lawful, our total liability arising from the service is limited to the amount you paid for MakeFlow in the twelve months before the claim. This does not limit liability that the law does not allow us to limit, including mandatory consumer protections.

Governing law and updates

These terms are governed by Estonian law, with disputes subject to the courts of Estonia, without affecting mandatory consumer rights or jurisdiction protections where you live.

We will update the date when these terms change and provide appropriate notice of material changes. Changes apply prospectively, subject to any agreement or notice required by law. Contact us with questions about these terms or your account.
